lu the Magistrate's Court yesterday, Mr. :W. CI. lliddcll, S.M., delivered judgment in tho caso of the Zcalandia Co-operativo Company, Ltd., v. , tho Marble Bar, Ltd., a..claim for £79 2s. 6d., balaneo allogad to bo duo for certain chairs and tables delivered at various timea by plaintiffs to fondants. Tho defendants alleged that the tables ivero not up to sample, and called expert evidence to support this vioiv. Tho Magistrate held that their valuo bad depreciated in some cases more than in others,'but most of them were still in use, and with few exceptions 6ould_ still bo used. Plaintiffs declared that tho deprivation was due to rough usage and to hot water being used on tho top of the tables, which affected the gluo under tho tile. After going fully into tho allegation of faulty construction, the Magistrate said the question was one of damages, and, after inspection, ho had fixed that at Bs. on each of the sixty-ono tables last supplied. This Teduced their price to £32 Is. 6d., which, with £18 2s. 6d. claimed for the chairs, mado a total of £50 4s. Judgment was given for' plaintiffs for this amount, with costs £2 45., and solicitor's foe, £3 10s. . .At tho hearing Mr. H. E. Evans appoared for plaintiffs, and Mr. A. W. Blair for defendants. Charles Robertson, £10, costs £1 3s. 6d.; Abe Mark Salek v. Sidney Gorman, £6 Is., costs £1 3s. 6d.; Caselberg and Co., Ltd., v.JH._Calton and Co., £5-95., costs Bs.; .Wellington Storcmon's Union- v.N. L. Greig, £1 os'. 6d., costs 55.; .Angelina' Diamond (known as Madame Bernard) v. Gerald van Heck, £43 175., costs £2 14s. In tho case of Allen Smith v. Frank Russell, a claim for £8 18s., judgment was given for plan tiff for the full amount claimed, with c<ssts £1 9s; ■ JUDGMENT SL'MMQNS. A. G. Faulkner was ordered to pay tho To Aro Furnishing Company tho sum of £3 10s. 7d. by May 15, in default to undergo thrco days' imprisonment. ; . ALLEGED BREACH OF AGREEMENT. ' ■■ Thomas-Bush, for whom Mr. Douglas Jackson appeared, proceeded against Albert Lawrence Knowsley, hairdresser and tobacconist, represented by Mr. H. F. O'Leary, to recover £2 2s. 6d., ono week's rent of premises known as 129 Willis Street, £4 7s. Gd., arrears, of rent, and £40 damages for an alleged breach of agreement to take up a new lease of the premises. After hearing the evidence, Mr. Eiddoll: reserved , his deci£K>n. Mr. L. G. Reid/'S.M., heard the police cases. . For insobriety, Mary I Duffy and Timothy Donovan were each fined 10s., in default seven days in gaol. William Cairns and John' Graham ivere fined 20s.' each, tho alternative being seven clays' imprisonment. Daniel Keano, with a long list of previous convictions, was committed to Roto Roa for a. period of twelve months. Joseph Daly was' convicted and discharged, for drunkenness, and for committing a grossly indecent act in Lorno Street .was fined 205., in default seven days' imprisonment. Five first offenders were convicted and discharged. John Wholan received a sentence] of seven days' imprisonment on being convicted of being an idle and disorderly person who! begged for alms' on Lambton Quay. Accused had been previously convicted of vagrancy. Henry Somerville, for using obscene language in Cuba Street, was remanded for a week for medical observation./ John Lavigno was remanded tintil today on a charge of attempting to commit a seriotis- offence en a. boy. v; JUVENILE COURT. ■ ■In the Juvenile Court, before" Mr. L. G. \Reid, S.M., four' boys were ■summoned to appear .on a charge of stealing the weights of window sashes from various premises in Wellington South and disposing of the same to a' secondhand dealer, hut as only one lad appeared the hearing of the case was adjourned to Thursday.
