MAGISTRATE'S COURT

Mr. L. G. Ecid, S.M., presided over a sitting of tho Magistrate's Court yesterday. CONCERNING A CHEQUE. Eobort Patrick Daley and Thomas Wilson, for whom Mr. H. I'. O'Leary appoarcd, wero charged with having wrongfully dealt with a oortain cheque as if it woro genuine. The signature on the cheque, purporting to bo that of E-. U. Harden, tho complainant, was stated by tho police to be genuine, but it was alleged that someone other than Harden had-filled in tho-amount (.£4B Os. 6d.), and that the accused bad caehed tho cheque. Dotective-Sorgeant Cox, who prosecuted, said thtit Harden had had a nervous breakdown Bomo years ago, and was at timee unablo to write his own signature. Ho thoroforo carried signed cheques about with him. He had made a trip to Masterton, and had 1 shortly after his return to. Wellington found that two cheques, signed, but not filled in by him, had been drawn on his account. Tho allocation waa that Daley had ontered a hairdresser's shop in Memteiton, and tried to cash ono of these cheques. Ho had boon asked to leave tho cheque and oall again; and later on tho hairdresser had cashed the chequo for him in the presence ©f Wilson. After evidence for tho prosecution had "been hoard. His Worship committed the accused for trial in tho Supreme Court. Bail was allowed each' in the eum of ,£75.

OTHER CASES. . , Phyllia Mollis, who was recently committed to the Salvation Army Home, pleaded guilty to a. charge of escaping from that institution. His Worship sentenced her to one month's imprisonment, and ordered her to be returned to the home at the expiration of that term. ' Alfred Hansen, a seaman, was sentenced to a month's imprisonment for deserting from hie vessel. Thomas Paul was fined 10s. for assaulting Claud James Cox. The assault, it appeared, hail teen witnessed by a policeman, who had failed to elicit an explanation from either of the parties. Joseph Brown, who, being a military prisoner in Trentham Camp, hnd escaped from dotention, was ordered to l>o handed over to tho militnry authorities. On tho first charge sho was sentenced to one month's imprisonment, and on tho second was fined 405., with tho alternative of 11 ; days in gaol. The case \>;as resumed in which Harold Gladston6 Olliver was charged with being in a dwellinghoiise by night with 1 intcut tn commit a crime. Inspector Hentlrcy conducted the prose- ' cniiou, and Mr. H. F. O'Leary appeared 1 for defendant. Detective Carney produced a signed statement niado to him by accused. This closed tho case for tho prosecution. 1 Olliver reserved his defence, and was committed for trial in the Supremo Court. Bail was allowed in the sum "of .£75.
