COURT OF APPEAL CHARITABLE BEQUESTS The Court of Appeal was occupied yesterday afternoon with the bearing of the case of John Vigor Brown and others v. Diana Eden , Knowles and others. This was an originating summons removed from the Supreme Court at Napier for argument in tho Court of Appeal. It concerned the will of the late Edward William Knowles, of Napier, the plaintiffs being the trustees and tlie defendants, the noxt-of-kiu of deceased. Mr. C. I'. Skerrett, K.C.. with him Mr. S. A. Atkinson, appeared for tho trustees, while Sir 'Francis 8011, K.C., with him : Mr. P. S. M'Lean, of Napier, appeared for the next-of-kin.' The Solicitor-General (Mr. J. W. Salmond, K.C.) represented the AttorneyGeneral. The Court is asked to decide the validit}- or otherwise of the testator's declaration that the "residue of' the residuary trust funds" should be held by the trustees in trust for. such charitable, benevolent, educational, and religious objects as they shall select. If tho declaration is held to be void, the question will then arise as to who should receive the amount involved, which is said to 1 bo between •£50,000 and <£60,000. ' Argument had not concluded last evening, and the hearing will bo resumed this morning.
