ESTATE OF THE LATE T. G. iIACAIiTHY. In the Supreme Court yesterday, the Registrar (Mr. W. A. Hawkins), delivered tho judgment of His Honour Mr. Justice Hcskiog in the case of the Public Trustee v. the Attorney-General, an originating summons wliicii had been brought to determine certain questions arising in connection with the administration of the estate of the late T: 'G. Macarthy. At tfye hearing, Mr. C. P. Skerrett, K.C., witlii him' Mr. ~T. W. Macdonald, appeared for the Public Trustee, while the At-torney-General was represented by the Solicitor-General (Mr. J. W. ' Salriiond, K.C.;. . .. The questions asked were: Had the Pub; lie Trustee as tho executor of the will ,of the deceased power under .the Pnblip Trust Office Act or: any other po\ver or authority to pay out of the Public Trustee's account certain sums lvithont obtaining an authorising order of a Judge of the Supreme Court Ha'd . tho Public Trustee power as executor to borrow money on tho security of tlie deceased's property without such an order? Did the.Public Trust. Office Act Amendment Act, 1913, limit the general powers of the Public Trustee nnder certain sections? His Honour held that the Public Trustee's powers were not limited, by the amending Act referred to and the' first two questions were answered in' tlio affirmative.
