Judgment has been delivered in the Supreme Court in tho action brouglit byGeorge W. Hean, chemist, Wanganui, proprietor of Hean's Cough Essence, ajrainst Percy S. Eaton, chemist, and William J. R. Hill, commercial '-traveller.' both, of Auckland, and trading as Hill's Essence Pfopt-ietary. The plaintiff sought to restrain the defendants from passing off a cough mixture which, it was alleged, w y as named, bottled, labelled. and. packed to resemble Hean's Essence, and thereby to mislead the public. - _ , Defendants did not appear, and Mr. Justice Hosking ordered that an-injunc-tion be issued restraining the above-nam-ed defendants from passiug off ot at.tempting to pass off aiiy cough essence not manufactured by Gcorgo W. Hean, and restraining defendants l'lom offering for sale any cough essence not of plaintiff's manufacture ..by means of the use of cartons, labels, and bottles similar to those of Geo. W. Hean. His Honour also ordered that the profits made therefrom be < computed by tho Registrar of the Court and paid over to tho plaintiff; that oil packages of / Hill's Essence offending against the injunction granted bo handed, oyer to the plaintiff, and that tho defendants also pay to the plaintiff J!26 Is. as costs and disbursements.
