CLAIM FOR DISSOLUTION OF

PARTNERSHIP

"This is unfortunately an action between brothers," said counscl for tho plaintiff -in opening a civil action in the Supreme Court yesterday morning, before His Honour the Chief Justice (Sir Hobert Stout). The plaintiff in tho action was Frederick iibeiiezer Gurney, basketmaker, of Wellington, and the defendant was Richard Comeliuo Gurney, basketmaker, of Wellington. Mr. T. Young appeared for the plaintiff, while Mr. T. M. Wilford appeared for the defendant.

The action was for dissolution of a partnership. Plaintiff (F. E, Guruey) alleged that he and tho defendant had been carrying on business in partnership as basketmakers for some years prior to March, l!)lu, but without any written deed of partnership or agreement as to the terms of the partnership. l'laintiff was desirous of having the partnership affairs wound up, but the defendant declined to give any assistance for that purpose. Plaintiff therefore sought a decree that the partnership bo dissolved, that acounts of the partnership be taken, and that g receiver be appointed. . The defence was a denial of the partnership. After hearing the evidence and argument of counsel, His Honour reserved decision.

JUDGMENT BY CONSENT. Judgment by consent, with costs according to scale, was entered yesterday morning in the civil action, James Spoight and Co., Ltd., v. Annie Duggan, a claim for £249 due on promissory notes and goods supplied. Mr. T. Young appeared for the plaintiffs (Speight and Co.), while Mr. T. M. Wilford appeared for the defendant.
