SUPREWp { COURT BOROUGH COUNCIL'S POWERS. In the Supreme Court on Saturday niorning, His Honour Mr. Justice Hoskmg heard an originating summons in which tho \Wanganui Borough Council asked for a declaratory judgment to detine its powers in connection with the settlement of liabilities incurred before the borough was enlarged. Tho defendants cited were the Australian Mutual Provident Society and tho ' AttorneyGenoral. Mr. W. J. Treadwell, of Wanganui, appeared for tho Borough Council; Mr. C. P. Skerrett, K. 0., with him Mr. M. J. Crombie, appeared for the A.M.P. Society, and the Solicitor-General (Mr. J. W. Salmond, K.C.) appeared for the Attorney-General. The question for the Court to answer was: Oan the Borough Council, by special m-der, in terms of Section 16 of the Local Bodies' Loans Act, 1913, raise a special loan for the purpose of paying off certain special loans falling due on .November 1. 1914, notwithstanding tho fact that these certain special loans were raisod before the enlargement of the borough, and that when raised they did not aifect certain areas now included in the borough? His Honour answered the question in the affirmative, and offered to give reasons should they be required. The' Attorney-General was awarded .five guineas costs, the other costs having been agreed upon.
