The rights of laud agents in dealing .with property to.be disposed of by auction were discussed in a case in which aarcourfc and Co., auctioneers, sued Itobert Wallace, farmer, of Aria, in the aikato, for £22 135., being 'commission claimed to be duo on the sale of a 1 property known as No. 10 Luxford otrect, Wellington. The plaintiffs claimed that they were authorised to find a purchaser for the property, the property which was put up for auction. Plaintiffs contended tnat it was the invariable custom to leave tho property in tho hands of tho auctioneers for a definite period after tne auction. Ihe properly was submittea lor sale, but 110 business was done, and after defendant notified plaintiffs that lie-had sold the property to a friend. As plaintiffs had stipulated that they were to have the right of private treaty within three months of the' auction, they made the claim for commission. Cox, of Eastbourne, settler, sued I tieorgo Clark and Patrick Dunn, painters, for the return of. a step ladder, vahied at £1 55., and 10s. damages for detention. The defence was that Clark had borrowed tho ladder, not' Dunn, lie Magistrate gave judgment for the plaintiff, with costs £1 15s; Mr. A. M. for the plaintiff, and Mr. W: Perry for the defendants. Arthur James Petherick, liquidator of the Gracefield Estate Sypdicate, Ltd., sued Francis Wallace Mackenzie, before Mr. D. G; A. Cooper, 5.M.,-for ii 0 8j m 7s. 5d., being moneys alleged to be due under an indemnity. ITie defence was a general denial of lia-bility,.'The-case was adjourned till ruesday_ for legal argument.
