A NEW POINT KAISED. Is there any authority under tho Defence Act whercbv a territorial who was | automatically drafted from thn old Volunteer force into the Territorial Force may bo punished for failing to rendor personal service in a camp of training? According to Mr. P. J: O'Rogan, who appeared as counsel for the youth Robert Hogp, before Mr. \\\ G. Riddoll, S.M., at the Magistrate's Court yesterday, there is none. Hogg was charged with having failed to render such personal service; and Ivis counsel, who- was opposed by Mr. 11. H. Ostler (acting for tho police), argued that Section 51 of the Act referred only to thoso who had to register under Part 0 of the Act, and had no reference to those, automatically drafted from the Volunteers. Tho' maximum flue which could 1» imposed by the commanding officer under paragraph 203 of tho Regulations was 10s., for failure to attend parade, and this fine, contended counsel, was all that the defendant could be held liable for, assuming that liability existed, at all. The Magistrate decided to reserve judgment in order to examine the point raised.
