DIVORCE.
AN UNUSUAL TYPE OF CASE. , By TcleErapb-Prcss Aosoclatlon-Coryriehl Christchurch, August 29. An unusual type of divorce case was heard in the Supreme Court to-day. William Cyrus Davio applied for dissolution of marriage with Elizabeth Anno Davio on the ground'of desertion. It 'was stated that the parties were married in, Sheffield, England, in August, 1896, petitioner being twenty-two years of age and respondent forty. Respondent had XtOO a year. Petitioner had a farm at Hawarden, New Zealand, and camo to New Zealand by himself three months after marriage to make a homo, his wife coming out later. The parties lived together till October, 1898, when it was arranged that thfl mother should return to England and settle her son of seventeen or eighteen veal's in business. After respondent had 'been in England for a few months slia wrote out that litigation had arisen which had deprived lier of a good deal of money, and she asked her husband to go to England to help her. Ho wis financially unable to do so. In 1900 petitioner asked respondent to come <qh<l live with hiiu iu New Zealand 1 , and she refussd, saving. that it was impossible. Desertion dated from then. Shortly after the son wrote; saying that ho had ashed his mother to come to New Zealand, and asking if pet-i----tioncr could (rivo him work on his farm. Petitioner replied asking his wjfe to come to New Zealand, but refusing to give tho son work. Correspondence then ceased till 190S, when respondent wrote asking for £25, which petitioner forwarded. Counsel for respondent said Mrs. Davi# went to England with her husband s full consent to transact important business. She was served'' with a writ in connection with Chaiicp.rv proceedings in 1900, and was thus unable to return to Now.Zealand' at that time. Her husband forwarded an ultimatum in 1900 that she should coma back to New Zealand, therefore her failure to comply with tho request could not be considered in the matter.
