MOTICE IS HEREBY..GIVEN, that at -H a Special Meeting of the Council of tho City of Wellington, held on tho 12th day of March, 1912, it was resolved ns follows-.— WHEREAS bjr Deed of Lease dated the 30th day of October, 1872, registered No. 07360, tho Mayor, Councillors, nnd Citizens of tho City of Wellington leased to tho Public Half Companv, Limited, inter alia, Sections 115, 116, and 117 Lambton Reclaimed Land, for tho term of 12 years from tho Ist day of January, 1872, nt tho rental ami upon and subject to the covertants nnd conditions set out in tho said Deed of Lease, AND WHEREAS by Deed of Lease dated the 17th dav of January, 1902, Registered Number 82370, the Public Hall Company, Limited, leased parts of the said Sections to Reuben Shallcrass Baker for the term of 10 years and eleven months from the Ist day of January. 1002, AND WHEREAS by Deed of Assignment, dated the 23rd day of May, 1907, Registered Number 90504, the said lands became vested in John Fuller, Benjamin Fuller, and John Fuller, the younger, for tho residue then to como and unexpired of tho term of years created by the said Deed of Lease, Registered No. 67300, AND WHEREAS tho said.John Fuller, Benjamin Fuller, and John Fuller tho younger, have requested tho AVellington City Council to accept a surrender of tho caul lease, Registered No. 67360, and to grant a new lease of tho cajd lands to them. NOW, THEREFORE, tho Wellington City Council, in pursuance and exercise of the powers vested in it by "Tho Municipal Corporation's Act, 1908," _ and all o.lher powers enabling it in this behnlf, doth hereby resolve by way of Special Order, To accept a surrender of the socd lease,- Registered No. G7360, in r.o far, as the same affects the said Sections 115, 116,'ahd : 117 Lambton Reclamation, subject to the said sub-lease, Registered No. 82.170,'' and to grant a new lease of the said lands to the surrenderors for the' unexpired portions of the term of vears created by tho said Deed of Lease, Registered No. G73GO, at the rental owl upon tho terms and conditions following :—■■'' 1. Tire present rental shall be increased from X 63 16s. per annum to .£1066 16s. 9d. per annum, pnynblo in advance as herein after provided for tho balance of tho term created by the said Deed of Lease, such new Lease to run from tho Ist dav of May. 1912, tho first payment , of rent, .£177 16s. 4-d., is to bo paid on ! (he execution of tho lease. Tho rent thereafter is to be payable in three holfvcarly instalments of J2533 Bs. id. on Ist July, 1912, Ist January, 1913, and Ist July, 19M. 2. The new lease shall contain a covenant for the granting of renewals of the said lease in perpetuity at an annual rental to be fixed by valuation of the full and improved ground rental of the said premises that ought to be payable during such new term without taking into consideration Die value, of any buildings or improvements then existing on the demised premises, for successive periods of fourteen, years, and such lease shall contain the same covenants mutatis mutnndis as are contained in leases of the T© Aro Reclamation,-.now granted by tho Wellington City Corporation.' 3. Tho said lease shall contain a covenant for the insertion of a covenant in the first renewal of the said lease in 1915, but in no other renewal to build on the said land within, eighteen months of the expiration of t.h,e term of the said new lease, a building of at least throo stories.in height, in compliance with tho By-laws for the time being in forc« in the City of Wellington. i.
