mediate stage shall be erected where it is reasonably possible and practicable. Bonkers. A banker shall be held to mean any plaoe permanently reserved for the stowage of coal for fhe ship's own consumption. Men working coal in such bunkers shall be paid at. trimming rates. Dirty Work. Men -employed oleaning np holds in which superphosphates, snlpher, guano, bonednst,- basic slag, and Japanese phosphates have been carried in bulk, shall bo paid for such work at the same rate as the men employed on the ship to discharge such cargo. . Men working in tanks and bilges, chipping and scaling inside boilers, and cleaning tubes, shall bo paid whilst so . employed Id. per hour over and abovo the rates set ont in Clause 2 hereof for overhauling work on ships. As cement and lime will now be shipped; in paper-lined packages, the question of any extra rato for these cargoes is deferred for six months from the date hereof, when, if necessary, it shall be dealt with jointly by the local committees of the various ports. Boilers. Boilers to be blown down, tops brushed off, and 6afety-valves to be examined before any man is allowed to work therein. Weights for Trucking. In loading or discharging cargo, a truck load for two men shall not exceed 12cwt., except in the case of a single package, which shall be above that weight; and a truck-load for one man shall not' exceed scwt.; and where these weights are exceeded assistance shall be given in proper proportion to the extra weight involved. At all ports where two men are at present employed for a truck-load of 12cwt, the existing practices to be continued. Weight and Constitution of Slings. These matters to be left to the discretion of employers, as hitherto. Preference. The employers agreo that, in the employment of labour, within the Bcope of this agreement, they will, at the respec- ' tive ports, give preference to members of the unions included in this agreement, and in consideration thereof the unions jointly and severally agree that during the,currency of this agreement, membership of the unions, or any of them, shall be open to any man, without ballot or other election, and that no fee sufficiently prohibitive to debar any worker from joining the union, and tending to create the union a close corporation shall bo charged during the currency of this agreement. ' The secretary of the union at each port to advise employers, from time to time, i the names of men who have ceased to be members of the union.' Employers employing labour Bhall not discriminate against any officer of the unions, or any of them. Application of Agreement. This agreement Bhall apply only to casual labour employed from day to day, or from hour to hour, and. shall not apply to weekly or permanent employees. Limitation of Agreement. This agreement shall apply (subject to the provisions of Clause i hereof) as folI lows: —(a) To the wharves, port, and har- ! bour of Auckland; (b) to the wharves, port, and, harbour of Wellington; (c) to tho wharves, port, and harbour of Lyttelton; (d) to the wharves, port, and harbour of Dnnedin; (e) to the wharves, port, and harbour of Timaru. Local Committees. Tho essence of this agreement being that the work of the employers shall always proceed in the customary manner, and shall not on any account whatsoever bo impeded, it is agreed that if any dispute , or difference shall arise between tho par- , tie 3 bound by this agreement, or any of L them, whether us to its construction or meaning, or as to any other matter what- ' ever arising out of, or connected therewith, every such dispute or difference as the same shall arise shall be referred to a committee to be composed of three representatives of the union at the port concerned, and three representatives of ' the employers for their decision. Tbe decision of the majority of the committee i shall be binding, and if no decision is arrived at, the committee shall submit the point in dispute to somo independent per- | son to be chosen by it, and if his decision is not acceptable to both parties, then the matter shall be referred for further negotiation to the New Zealand Federa- ' tion of Labour, and tho employer or employers concerned. ■ The above-mentioned Local Committees I shall also deal with tho various matters specifically referred to them by this agree- , mi-nt. •Term of Agreement. 1 This agreement shall come into force on February 1, 1912, and shall continue in " forcoi until January 31, 1911, and there--1 after shall continue in force until super- * coded by a new agreement.
