CLAIM FOR COST OF THE WOOD. (By Telecraph.—Preis Association.^ Wanganui, November 28. An nriusual caso occupied the attention of the magistrate to-day. Some months ago a man named Gibbons committed suicide by _ cutting his throat and incinerated his body on a stack of manuka. Iho. owner of the wood, some 45 cords, tOKlay sued tho Public Trustee, as administrator of deceased's estate, for the value of tho wood (-M5). Mr. C. C. Hutton appeared for Mr. Sutherland, and Mr. C. E. Mackay for, defendant. Mi-.' Mackay stated'that the "Public Trustee was defending solely .because he did .;not feel justified in paying such a claim/without an order, of the Court. Eviddnce was 'theli heard. ' -- Iu giving judgment, Mr. Kerr, S.M., stilted, that, although. Gibbons might have been a lunatic, the evidence showed that he knew what lie was doing. He was consequently responsible, and so was his .estate. He gave judgment for plaintiff with costs, but limited tho judgment to such assets a3 might be found in the sstatc,
