INTERESTING CASE.

GERMAN STEADIER AND.CHINESE FIUEMEN. (Bγ Telcsraah.-rresa Association.) Duncdin, October 20. Tho eight Chinoso arrested for refusing duty on the German steamer Wa.lkifro came before tho Police Court yesterday, pleading not guilty.. M.r. W. C. Mao Grugor, in answer to a point raised by Mr. SeiiTr for the defence, that the Court bad not jurisdiction, produced a Gazette of 18G9, showing that the North German Confederation had in that year claimed tho benefits under our Shipping Act of ISGO, aad that the proclamation had never been revoked. Mr. Scurr retorted that the North Gorman Confederation went out of existence after, the Franco-Prussian war, and there was no agreement as to German ships nor evidence that this nation desired tho benefits of our Act. Dunedin, October 21. Mr. Bartholomew, S.M., gavo his decision this morning. The crucial legal points were, had tho North German Confederation lost or retained its identity as an international entity. The Magistrate gavo his opinion, on the strength of authorities quoted, that it had lost its personal identity, and that, therefore, there would bo no nation to whom tho Gazette notice applied. Ho took it that tho Court had no jurisdiction, and discharged the informations. An interesting point cropped up as to what would bo <lone to tho men after lwiug discharged from custody. Mr. Bartholomew pointed out that under tho Immigration Restriction Act- the police could put the men back on the ship. It is contended in legal circles that if action is taken under habeas corpus, the police could bo prevented from putting tho men on board.
