THE COURT OF APPEAL.
A WILL CASE. AND SOME OTHER SUITS. In the Court of Appeal yesterday argument was concluded in regard to a motion for confirmation of tlio Registrar's report as to remuneration of trustees and executors in tlie matter of tlio Administration Act, lflOS, and the will of Allan M'lvean, late of Christchurcli, deceased. Tlio lieneh was occupied by the Chief Justice (Sir Robert Stout), Mr. Justice Domiiston, Mr. Justice Edwards, and Mr. Justice Sim. Mr. T. W. Stringer, K.C., with liim .Mr. Levi, appeared for Die executors of the will (Hcur.v Cotlcrill, solicitor; Boulton Merlin Molineaux, bank manager; and Geo. Francis Gee, bank manager); and Mr. T. G. Russell appeared for the M'Lean Institute (the residuary legatee under tlio will). Particulars of the motion were published in yesterday's issue. At tlio conclusion of argument, the Court reserved decision, and adjourned until 10.30 a.m. on Monday. MR. MASSEY'S CASE. Mr. G. H. Fell asked leave to mention tlio ease of Massey v. the "Now Zealand Times" Co., Ltd., in the Court of Appeal yesterday. Mr. Fell said tliat conditional loavc to appeal to the Privy Council had been granted, and ho now asked for final kavo tor plaintiff to appeal. Mr. A. M T . Blair, on behalf of tho defendant company, consented, and leave was granted, an order being made for the records to go forward within CO days.
