MOUtfT RADIANT LEASES. Westport, September 11. In the Wardens' Court to-day Mr. Eaw6on delivered judgment in tho Mount Radiant mineral caso in which R. Johnson sought to recover from Ferguson and Gascoyne, of Napier, possession of titles to certain mineral leases at Mount Radiant, and also .£2500 damages for alleged illegal retention of same. Tho warden (1) refused the prayer of plaintiff in regard to assignment and damages. (2) fie decreed that the defendant should hold the leases on trust for persons advancing money to pay creditors, all purohasoTS of sharos, prior to October 11 and for Johnson and Purdy. (3) That tho agreement of May 13„ referring' to tho sale of one thousand snares to Ferguson, should bo cancelled, and that defendant should deliver over tho six agreement forms referred to in the judgment ox, in the alternative, execute an indemnity to plaintiff against any claim that may ariso in respect of any dealings with them on tho part of defendants, and account for tho proceeds of sale of any of them (if any) sold. It was understood that, if an appeal were not prosecuted, further terms and the question of costs would bo settled after tho hearing of the parties by t'h'o warden.
