AN ATTORNEY CANNOT ACT.
PECULIAR POSITION. An apparently peculiar position came in for some notice at Hie band Hoard meeting yesterday. This was with referenco to the application of Mrs. 1,. V. Woolston to transfer Section 5, Mock XV't, Kaitieke. to Mrs. ,1. C. Yiekors. The Commissioner advised (he board that Sirs. Vickers was at present in Kngland, anil that her husband, who holds the power of attorney, had submitted the usual statutory declaration executed by himself. All'. M. •!. Crombie, who appeared for the 'transferee, said that he understood that the board was not prepared to acript, the declaration, but he submitted' that: the attorney wns in a better position In act in this case than the transferee herself. The. Commissioner replied thai the board was unwilling to accept the nllorncy's declaration, as there was no p|.„. vision in the statute for adopting ,sneh 11 course,' while it was specially provided that an attorney could act for n romP V r . Crombie pointed out that the refusal to accept would necessitate great delay in the transfer, He submitted that there were plenty of things not provided for in the statute but which had brcomo established by practic. He asked if the Commissioner had had the Solicitor-Gen-eral's advice on the question.
