FORESTERS' HALL, TORY STREET. AS A PICTURE THEATRE? The hearing of the claim for specific performance, David Morris Owens, builder, vi W. H. Stewart, land agent, and Beatrice A. Pinnock, wife of George Pinnock, hotel manager, was concluded'in tho Supreme Court yesterday .before his Honour Sir Joshua Williams. , Plaintiff alleged that Stewart, repreeenting JiimseJf as the agent of Mrs. tinnock, contracted with him for the purchase of the Foresters' Hall, Tory Street, for the purpose of turning it into a picture theatre. The price agreed upon w;is ,£3500, and certain alterations were made by the plaintiff, but defendants did not complete the purchase. He consequently asked for a decree for specific performance, and for ,£505 damages..... ■■' - - Defendants denied that any contract had ever been entered upon. Stewart counter-claimed for <£150 15s. as moneys paid in. anticipation of the sale, being made. His Honour reserved decision. Mr. A. Dunn appeared for plaintiff, and Mr. Oswald Beere for defendants. COURT OF APPEAL. ' The Court of Appeal wjll open its sittings in the Supremo Court this morning. The first case will be one in re, the New Zealand Insurance Co., Ltd.
