The decision was carried by a majority of one, Mr. Justice.Higgins and Mr. Justice O'Connor dissenting.

Tho Court ruled that an industry contcmplnted by the Act is one wherein both tho employer and the employee aro engaged, and not merely in an abstract sense, or, in other words, that tho labour of an employee given for remuneration from an employer does not constitute an industry. The caso is important, as it affects the Broken Hill Proprietary Company and 175 other respondents.
