MAGISTRATE'S COURT.

(Before Mr.-W. G. Riddell, S.M.) A FIGHT WITH A CANVASSED George Jelley , (Mr. E. J. Fitzgibbon) and Arthur Pickard (Mr. H. F. O'Leary) were charged with' using threatening behaviour inLuxford Street on November 7, and thereby causing a breach of the peace. Both accused: pleaded not guilty. From the evidence, it appeared that Pickard,' who d-escribed' himself as a canvasser for enlarged photos, and stated that he belonged to ■ the "hatless brigade," had received-.an order, for an' enlargement from '.Mrs; Jelley, but the latter refused-to accept delivery as sbo :Was not satisfied with the picture. Pickard then called at the house several times, and threatened to summons Mrs. Jelley, but stated in court that ho was only bluffing, or "putting the acid on." On November 7 Pickard called, and was met at tho- door by George Jelley, and ordered off the premises. A tight then ensued, and although Pickard stated in court.that he "could, get all over" Jelley in a ring, it appealed that he got tha worst of the encounter in Luxford Street. The Magistrate held that Jelley was justified in. ordering Pickard off his premises, but not' in following him into the street, and. must therefore be convicted. Pickard, by his persistency, had brought the trouble on himself, and would also be convicted. Each was fined 205., with costs 95., and witness's expenses 35., in default 4S hours' imprisonment. ■ >. ONE TEAR'S IMPRISONMENT. An old Woman' named Jessie Edwards, alias MTSwan, pleaded guilty to a charge of being a rogue and a vagabond, and whs sentenced to .a year's imprisonment. "NOT PREPARED) TO CONVICT." Maurice. Michael pleaded not guilty, to a charge of being an idle and disorderly person. After'. . hearing evidence, the Magistrate said ho was not prepared to convict, and the charge was accordingly dismissed. . CHARGE OF THEFT. FAILS., A,fruit hawker, named Walter Miles, for whom Mr.. K. Kirkcaldio appeared, was charged with stealing, on November. 26, a sack of peas, valued at 7s. 3d., the property of Laery. and Co. It was alleged that' accused had been seen to remove from the auction room a sack that did not belong to him, but the evidence showed that another sack of peas had been "knocked down" to his bid, and the defence was that an innocent mistake had been made. The information was dismissed. DAMAGE AND ASSAULT. Guv Cockburn (Mr. H. F. O'Leary) pleaded guilty to a charge that on November U. he damaged a glass indicator, a mug and a glass, of a total value of 13s. 6d., the property of Geo. Tullooh. He also pleaded guilty to a charge of assaulting Edward Logan on the same date. For the first offence he was fined 205., and ordered to pay 13s. 6d. for the damage done,. in default seven days' imprisonment, and for the second offence a fine of 405., was imposed, with witnesses' expenses Bs., in default seven days' imprisonment. HAINING STREET AFFAIR. George Bcynon (Mr. H. F. O'LeaTy) was charged with assaulting Now Bee in Haining Street on November 4. After hearing lengthy evidence, the Magistrate dismissed tho information. RESISTED THE POLICE. A middle-aged man named Georgo T. Goldsmith was charged with drunkenness, with resisting Constable Gedge, and with damaging the constable's shako and badrre, valued at 7s. Gd. Accused pleaded guilty to all three charges. For the first offence ho was convicted and discharged, tor the second 1 ho was fined 405., and witness's expenses 45., in default seven days' imprisonment, and for the third he was convicted and ordered to pay the amount oi tho damage, in default twenty-four hours' imprisonment. INSOBRIETY. Patrick Sullivan, alias Holland, whe was charged with drunkonness, had pre. viously been convioted on 51 occasions,

Ha was sentenced to a month's imprisonment, a prohibition order to'issue against him. :, Hjnry M'Ccrmack. against whom there were 125 previous convictions, and who had not long since been discharged from tho Pakatoa Inebriates' Home, was.charged with drunkenness, and fined 205., in default seven dnys' imprisonment. Two (irst-olfending inebriates' were fined 55.. with the alternative of twenty-four hours' imprisonment, and another first offender, who had been in the cells since Saturday, was convicted and discharged. OTHER CASES. For breach of a prohibition order, Norman M'Phce was fined 405., in- default seven days' imprisonment. On a charge of drunkenness, the same accused was convicted and discharged. A charge against Mrs. Geo.. /fisher for supplying liquor to a pronibited person was adjourned until December 5. BOARDED A MOVING TRAIN. ' For boarding a moving train, H. Ryan was fined 55., with costs lis., and witnesses' expenses Bs., in default 48 hours' imprisonment. / BY-LAW CASES. Frank Wilson (Mr. V. R. Meredith) was charged with, on November 5, driving a motor-car along Onenu Road at a speed dangerous to the public. Evidence as to tho speed' of the car was conflicting, and tho" magistrate dismissed tho information. For depositing building . material in Rintoul Street without placing a suitable lamp thereon, Frederick Stacey was fined 10s., with costs 7s„ in default 48 hours' imprisonment. For allowing a chimney to catch fire, a Chinaman named' Chow Gow was fined 55., with costs 75., in default 21 hours' imprisonment. . For leaving a vehicle unattended for more than five minutes, Patrick Hcaly was fined 10s., with costs 75., in default 48 hours' imprisonment. MAINTENANCE CASES. Violet May Rosa Shepherd was granted ; remission of arrears in respect to a main- < tenanco order,'and the paj'mciits were reduced to ss. a week. Charles Stevens was ordered to pay arrears due under an order for the support of his wife, tho payments to. be reduced to 13s. per week when the arrears are paid. There was no appearance of the complainant in the case against Frederick .Charles Wilson (Mr. Cracroft Wilson) for failing to support his child, and the information was dismissed. In the case of Fryer v. Fryer, an application for summary separation, there was no appearance of either party, and the case was. struck out. " " . An adjournment till December 12 was granted in the case against Thomas Hodges for alleged. disobedience of an order of the Court. Hearing of the charge against Georgo Hill, for alleged failure' to maintain an illegitimate child, was adjourned till December 5. A charge against David John Dumbleton, for'alleged failure to maintain an illegitimate child, was further adjourn»:l till December 5. Mr. H. F. O'Leary appeared for defendant, and Mr. T. M. Wilford for complainant.
