A LICENSING CASE. , ; v ; > A BOUNDARY COMPLICATION, i Mr. Justice Cooper, sitting: in Bauco yesterday morning, had before him an application on an originating .summons by llenry' Walters, licensee ot the ■ Seddouville Hotel, whose application tor renewal adjourned, by tiio"Motueka , Licens- : iiiif Committee, ■ pending the decision of the .Supremo, Court' as. to whether the committee could legally grant-the rcuewal, the boundaries of- .the licensing, district having been altered in ..the meantime. . !' An application i'o'r -the .removal of the hotel, to ..a point, a short distance further north had been-made iu September, 1808, and adjourned by the 1 ' committee for measurements, to be,, taken, Jjiit', granted by ; tho committee in December of the same year. During tho interval of the adjournment, ■'tho boundaries had been altered, leaving a vacant license' in the adjoining district of Butler, and giving one too many to the Jlotueka distjict. It was at the last meeting of the.. Stotueka Licensing Committed that tho. matter was. adjourned as , above stated, for the decision of tho Supreme Coitft,- and the case Jupon an originating 'summons under: the Declaratory' Judgments Act 'came :be-. fore Mr. Justice Cooper ■ ■ Mr'.Maginnity, of : Nelson; who appeared for the, licensee, said that, the Licensing Committee,. as shown by the Affidavits that had been filed, consented to abide the decision of the Court and expressed its readiness, to grant tho licensee if the Court was.of opinion that it could legally do so.
