In the ICing's Bench Division action was brought by Messrs. W. W. Greener, a firm of gun and riflo manufacturers, of Birmingham, against Livingstone, Zeytoon, and Co., Limited, to. recover damages for breach of contract to purchase 2400 Crown brand rifles. It was stated that tho rifles were obtained from the Australian Government and were in two classes—Mark 111 and Mark 11-but wcro the same in quality. Messrs. W. W« Greener, said counsel for the plaintiffs, sold 2400 of these arms to the defendants, who refused to take delivery on the ground'that it had been represented to thorn that Ihe rifles were Crown brand, If ark lII', which had a ready sale ou f;ho Muscat market, and that the plaintiffs tried to pass off on them Mark II rifles as Mark 111, which they were justified in rejecting.
