Fraser, EX., stated thai Frapwcll had imported goods from 1 Messrs Watts, London. Watts sent tiro invoices accompanied by a letter. This stated that, for Customs purposes, the second invoice was enclosed, and on it. was,attached,the usual declaration mado, v ~) by a' ', shipper 1 . This Invoice set forth the value of the goeds at loss than was the actual case In, fact, it placed the value of the goods at £25, whereas the real value was £32 is., so that Watts, in saving £1 duty, trapped his customer into a serious offence, involving a penalty of .£IOO ! The Collector of Customs stated that he was satisfied' that defendant was' the victim of fraudulent practice. • Mr. Mayne, 'for defendant, pointed out that he had not asked Watts to send a false invoice. Tho magistrate said thai he was satisfied that no : moraT blame to defendant,, and Mr. "Praser remarked l that the shipping agent (Mr. H. E. Campbell) was. also. unSware of the second invoice.' Defendant was formally; fined J!100,> but this was reduced to .£25, and cost S3 12*.
