'HUTT COUNCIL MUST PAY, The two claims against tho Lower Hufct Borough Council, for land taken in connection with tho widening of Parliament Street, vera «et tied by r the Compensation Court yesterday, tho bench comprising Mr Justice Sim, the Hon T. K Macdonald, ML C (assessor for claimants), and Mi W G lostcr (assessor foi tho council) Mr Gray appeared for claimants, William George Emctts, builder, and his wife, Polly Emeny Mr' Blair represented the Lower Hutt Borpugh Council The first claim (in regard to Mr Emeny's property) was mado up as follows —Valuo of land, £U1 15s ; improvements, £70 10s , 10 per cent for compulsory taking, ,£2l 4s , loss of sh6lter and privacy, J!SO, los>s of convenient access and approarh, £20, new fence and gates, ,£2B 95.; breastwork, JE2 16s. Tho sum of .£3lO 9- was claimed bi Mrs Emeny in connection with the loss of her liind: >Valuo of land, i>l9o; improvements, £A 1 los ; 10 per cent for compulsory taking, J223 155.; lefss of shelter and privacy, JE2O, new fence. .£l7 IDs ■ breastwork, .£ll 14s Tho strip of land taken by tho borough authorities was part of a plantation of native trees, which sheltered j;ho houso and garden, and screened the property from the viow of railway passengers Tho Court, after visiting the proporty, made an award that the respondent council should pay to Mf Emeny tho sum of £160,' unci to Mr! Emony the snm of J8152, m satisfaction ot their respective claims No order was mado for costs in either case The president of the Court fitcd the assessors' fees, for each case, at six guineas each, and ordered that the) should bo paid by the respective parties '
