SUSPENSION OF CAPTAIN'S CERTIFI- , CATE. ' : NOTICE OP APPEAL LODGED. ; An appeal has been lodged in tho Supremo . Court by Captain Naylor, master of the illfated s.s. Penguin, against that portion of ] tho decision of tho Court of Inquiry which j involved'the suspension of his certificate for ( a period of twelve months. j Tho grounds of the appeal are as under: — (1.) That it was not proved that tho , casualty was due or contributed to by any negligenco or wrongful act or default of the j master. . i (2.) That it was not proved that underthe existing weather conditions at any time after 9 o'clock on tho night of the disaster shelter should have been sought, or tho vessel's head 1 put out to sea, instead,of her courso being j continued to Wellington. 1 (3.) That it was not proved that tho master under tho existing circumstances was guilty of a breach of Article 1G of tho Regulations for Preventing Collisions at Sea. (4.) That it was not proved that undor tho circumstanccs shown by tho evidence • tho mastor should liavo taken soundings. _ _ . (o.) That there was no evidence to indi- ' cate where tho vessel struck, and, in particu- j lar, there was no ovidor.co to indicate that , the vessol did not strike an uncharted rock s or submerged wreckage. _ i (6.)
