At tlio Supremo Court to-day, argument was heard oil an originating summons, issued under tlio Licensing Act, 1908, relating to tlio Rotherfield Hotel. Tlio summons was taken out to decido a question arising out of tho refusal of tile landlord of tlio hotel, C. DoaL,_to consent to tlio transfer of tho lcnso and license from tho present tenant to Daniel C. Kellcher. Section 179 of tho 'Licensing Apt, 1803, provides that a landlord shall not arbitrarily or unreasonbly withhold his consent to a proposed assignment. After hearing evidence, his Honour dccided that tho refusal to consent to the assignment was unreasonable, and he ordered tho landlord to consent to tlio assignment'. Mr. Cassidy appeared in support of tho summons, and Mr. Stringer to oppose. This is claimed to bo tho first case of tho sort heard iu Now Zca- 1 land. OVER-PROOF HOP EEER. HEAVY FINES. Glsbome, February 27. John Gallagher and William Pollard pleaded guilty at tho l'olico Court to a cliargo oi : carrying on business as brewers without a license and selling liquor without license at tho railway camp, Yvaihuka. Tho Crown Prosecutor said that tho Act.only allowed three per cent, alcohol in hop beer, but defendants' wares contained G. 39 per cent. Pollard had v been convicted for tho same offences at llaurimu. Gallagher was fined £10 or 30 days for brewing, and £10 or thirty days' imprisonment for selling, and Pollard £20 or two months' imprisonment for browing and £20 or seven days' imprisonment for selling.

Napier, February 27. _ Mr. Vigor Brown, M.l'., having communicated to tlio Premier tho resolution of tlio Napier Drivers' Union protesting against tho appointment of Mr. Mario Giles as Conciliation Commissioner, Sir Joseph" Ward replied: "It is tho intention of tho Government that Mr. Giles shall havo a full and fair trial in the responsible) position to which ho lias been appointed." Auckland, February 27. A meeting of the exccutivc and tho council of the Auckland Liberal and Labour Federation passed a resolution of regret at tho resignation of tho secretary (M r. I'. Harlo Giles), congratulating him on his appointment as a Conciliation ■ Commissioner and expressing deep regret at tho unwarranted attacks mado upon a citizen so highly esteemed.
