MAGISTRATE'S COURT.

POLICE CASES. (Before Mr. W. G. Riddell, S.M.)

At the Magistrate's Court yesterday, a young man named John Mcech pleaded guilty to a charge of having on October 2 at Wellington stolen nine yards of silk, two bottles of scent, and. three children's petticoats, of a total value of £3, the property of one Kate Clarke. Chief Detective M'Grath informed the' Court that accused had been employed as a driver by the Colonial Carrying Company, and on October 2 was engaged to remove some goods from the company's store to Mrs. Clarke's residence at Hataitai. The articles mentioned in the charge were taken from a wardrobe. Two pieces of silk were sold for 10s. each and a tliird piece was sold for 12s. 6d. Accused was remanded until this morning for sentence, to enable the police to make further inquiries about him. Minnie Aldridgc pleaded guilty to a charge of being an idle and disorderly person. Accused was convicted and sentenced to three months' imprisonment. One first offender for drunkenness was fined 10s., and three others were fined ss. each. CIVIL BUSINESS. (Before Dr. A. George Culling, £12 4s. 6d., costs £1 10s. 6d. • JUDGMENT SUMMONSES. In the judgment summons case, Margaret Smith v. Andrew Johnson, a debt of £6 10s., debtor was ordered to pay on or before November 10, in default seven days' imprisonment. E. J. Andrews and Son were ordered to pay £9 6s. to the "New Zealand Times" Co. before November 10, in default seven days' imprisonment. A SUIT OF CLOTHES. E. Norton and Co., tailors (Mr. Barnett) sued Allan Steel Ramsay (Mr. Jackson) foi £3 55., the price of making a suit of clothes, the material for which" was supplied by defendant. The evidence showed that defendant purchased some inferior cloth from a traveller, and gave it to plaintiffs ,to make up into a suit. Plaintiffs told defendant thai the stuff was not worth making up, as it was of such poor quality, but defendant still wanted the suit made. The result was that the first day on which defendant wore the new clothes the trousers split across the back. His Worship gave judgment for plaintiff for £3 55., with costs £1 los. COMMISSION ON AN EXCHANGE OF LAND. \ Thomas Vernon Venables, commission agent (Mr. Dunn), sued Alfred Benge, farmer (Mr. Treadwoll), for £124 Bs. 9d. Tlio statement of claim set out that defendant employed plaintiff as agent to dispose by way of exchange of his property at Munga'roa, the prico of the land to bo £4977 10s., and plaintiff's commission to be £2 10s. per cent. Plaintiff also claimed, that a contract for tho exchange was arranged through his agency. '• After tho evidenco in support ofplaintiff's case had been heard, further hearing was adjourned until Friday. ROWING CLUB AND EX-MEMBER. j ' (Before Mr. W. G. Riddell, S.M.)' • The Wellington Rowing Club '(Mr. Neilson) sued William G. Nias for £2 7s. 6d., balance of subscription alleged to be due to the club. Defendant stated that ho was of opinion that he stood square with the club, but lie had received no receipts up to the time he tendered his resignation.. His Worship gave judgment for the amount claimed, with costs. CONCERNING A WILL. Arthur George Jacobson, painter, sued Albert Valentino Jacobson, printer, and John Gustave Jacobson, plumber, tho executors under the will of tho late Hans Jacobson, for tho sum of £8 19s. 5d., money alleged to have been received by tho defendants in May, 1908, for tho use of plaintiff, and stated to have been retained by them. Tho defendant, John Gustavo Jacobson; counter-claimed for tho sum of £16 for board and lodging from July to November, 1901, being twonty weeks at 16s. a week. Tho defendant gavo plaintiff credit for £4 45., being the amount paid in part payment, and the counter-claim was therefore for the balanco, £11 16s. His Worship gave judgment for tho plaintiif for tho amount claimed, with costs 13s. Tho defendant was nonsuited on the counterclaim. Mr. Dix appeared for tho plaintiff, and Mr. Blair for the defendants. BOARD AND LODGING. Constantino Georgo Nieholl (Mr. P. W. Jackson) sued Win. M'Kins try (Mr. Ncave) for £2 10s., for board and lodging, and money lent. Judgment was given for the plaintiff for l tlio amount claimed, with costs £1 12s. MOUNT COOK POLICE COURT. At tho Mount Cook Police Court yesterday morning, before Mr. J. Smith, J.l'., two first offenders were convicted and discharged.
