ORIGIN OF A BUSH FIRE.
UNSUCCESSFUL CLAIM FOR DAMAGES. (D { TEtEfISArH—PFESS ASIGCI4TIOS / . . ■ . . Carterton, October 23. . A sitting of tho Magistrate's Court was held all day yesterday, till 6 p.m., befort Mr. W. P. James, S.M., to hear 'a case arising out of the recent bush fires during tho drought. A. 0. Gallon-claimed from W. C. Ordish £291 damages, alleged to have : been caused by a Ero lighted by defendant on February 0, which broke out afresh on March 1, when it swept plaintiff's property; Tho claim was afterwards reduced to £91. His Worship held that plaintiff had to ' prova that the fire lighted by Ordish op February 6 was responsible for tho damage done by fire on March 1. After hearing tho evidence of soven witnesses for tho plaintiff, and nine for the defcnce, his Worship summed up, though the defeJico had still witnesses to call, holding that plaintiff had only proved that the firo raging on the flats had done hirii damago, but had not shown - where the firo originated. Tho defence had conclusively proved that the fire causing the damage camo from tho back 1 of the hills, and not fronr Ordish's property. Plaintiff was nonsuited, with 'costs £20 3s.
