When the jury assembled ■ to-day it was announced that one of the jurymen had been . taken ill'at his rcsidenco and was unable to be present Counsel on both sides filed an agreement ' signed by tho prosecutor, both accused and 1 both counsel, agreeing to accept the vcrdict . of tho remaining eleven jurymen. This courso was taken under the Crimes Actcompiled lately. ~ When the evidence for the Grown had , closed, counsel for the defendants asked his . Honour if tho case should go before the jury. Tho judge replied that it was exceeding]; weak, but he would not undertake the • ro»' sponsibility of withdrawing it from tho jury. Ho left it to tho jury themselves to decids whether they desired to hear the'defence of * tho accused. Tho jury decided to acquit without calling on tlio defence. The prisoners wore then discharged. , ; ' This closed the criminal cases and one of tho longest sessions held hero for many years.
