SUPREME COURT. I IN CHAMBERS, A sitting in Chambers was held by Mr. Justice Cooper yesterday. Probate of the wills of tlio following deceased persons was granted:—Annie Bro'vn, widow, Wellington (Mr. Morrison); Vincenzo Buti, cabinet-maker, Wellington (Messrs. Bunny, Peterick and Ayson); Martha Ellen Ross, widow, Wellington (Mr. Hindmarsh); Ellen Scott, widow, Pctono (Messrs. Izard and Weston); Walter Maldon Hare, machineruler, Wellington (Mr. Somervillo); and Joseph Day, Wellington (Messrs. Bunny, Petherick and Ayson). Lettors of administration were granted in respect of the estates-of the following deceased persons:—Alfred Chas. Ellis, sawyer, Rauene (Public Trustee); and Mary Ann Sarah Wilkinson, 1 spinster, Wellington (Messrs. Young and Tripe); The case of Harry Plimmer. v. the District Land Registrar was then mentioned. Briefly, the facts are that: tho late John Plimmer was the owner of certain properties fronting Plimmer's Lane and ■ Plimmer's Steps. By .his will lie devised the several properties to different devisees. Tho defendant refused to register the transfers from the executors to the devisees in terms of tho will unless tho street were widened in accordance with Section 117 of. the Public Works Act. Plaintiff, who is one of the devisees, then issued a summons against defendant to show cause why his transfer should not be registered." His Honour,. on suggested that the parties should agree to the removal of the case into the Court of Appeal.. The point was, he said, one of considerable importance. Yesterday, by consent, the necessary order removing the caso was made. Mr. Beere appeared for the plaintiff, and Mr. ■ Pauling, ■ deputy-dis-trict land registrar, appeared in person..
