In crossv(Examination the clerk to-the board said that by tho time mentioned above all the members had beea told that they should have goyo out of office the previous September iu terms of . the Act In .answer to, further questions witness said that the Reading of tho Act. was gbsouro,..an'd member? thought tliey had a right to remain .in/ office, till their successors Were'appointed.' Counsel for tho defence submitted there was' 1 no 1 plaintiff m existence, and his Worship nonsuited plaintiff. Leave to appeal was granted.
