REMARKS BY A JUDGE. v Auckland, August 19. 11l the course of evidence at the Supreme Court to-day in a charge of robbery, a young policeinan, under a severe cross examination by Mr. Lulidon, said ho had made a note at the time of what a fomalo witness , told him oil the dato of tho robbery, July 23. He prepared a full statement from his notes and showed tho statement to tho witness at tho Supreme Court a week ago. His Honour, Mr. Justieo Edwards, stigmatised the procedure as most improper. Addressing tho witness his Honour said:— " You Tiavo no business to do anything of tho sort, and you have no business to refresh a witness's memory in this way. You have taken brief notos, and added to thorn, making a full roport. That is manufacturing evidence. The witness should coino here, not according to your notes, but according to hor memory. I hope I shall not find anything of the sort again. If Ido I shall havo to tako somo serious notice of it."
Speaking to the Hon. J. A. Tolc, K.C., Crown Solicitor, his Honour added: "Theso witnesses' havo no business whatovor to bo coached by tho police from their notes. They must como horo according to their memory. I must say it is somewhat shocking."
