COMPENSATION COURT.
SMITH AND SMITH VERSUS CITY CORPORATION. - CLAIMANTS AWARDED £-160. Tho Compensation Court, which consisted of Mr. Justice Chapman and Mr. J. Trevor, assessor for tho claimants, and Mr. E. AY. Seaton, assessor for the respondents, announced its/award in connection with tho suit of Smith and Smith, Ltd., the City Corporation yesterday.' Tho facts in -this caso were briefly as follow: —Claimants hold sections 7 and 8, block 5, Reserve K, City of Wellington, under lease from the Corporation, 'l'he lease in respect of section 7 dates from July, 1900, and that in fegard to section 8 from September, 1897, and the term in both cases is twenty-one years. Claimants' warehouse stands on scction 8, and tho business premises of Messrs. Yercs, Barker, and Finlay on the front portion of section 7. Originally claimants had a yard measuring 60ft. by 42ft. at the rear of section 7. Under the provisions of tho Public Works Actj the Corporation acquired half of tho yard. Claimants sought to recover £510 from the Corporation in respect of their interest in the land taken and £1350 in respect of alleged injury to tho balance of-the property as a result of the land' in question teing resumed. : Tho Court awarded £460 by way of , compensation for tho land taken, and ordered that' tho, rent paid by tho claimants to the respondents bo reduced by £17 13s: 4d; per annum as from March 31, 1907._ The assessors' fees were fixed at 14 guineas each, and directed that each party should pav its own assessor. ' ; : Mr. D. M. Findlay appeared on behalf of the claimants, and Sir. O'Shea for the Corporation. '
