In connection '.with the reported appointment of the Taotai of Swatow, Leong Lan Fun, to tho position of Consul-General for China in Melbourne, tho Commonwealth Department of External Affairs was advised indirectly somo time ago that a Consul was to be sent to the Commonwealth,,! and also ono to New Zealand. Tho. next criminal sittings of tho Supremo Court at Wellington, which will commence on Monday, August 17, will be presided'over by Mr. Justico Coopor. So far, nino charges have been set down for hearing. They aro as follow:—John Griffin, indecent assault; Arthur Nankivell,'criminal assault; Ellen Johnson, attempted illegal operation; William Gunn M'Kay, theft (two charges); James Smith, alias Grift'o, theft from the person; Patrick Ryan, indecent assault; Georgo breaking, entering, and theft; and Daniel Murphy, theft. A meeting of tho Women's Section of the Navy Leaguo is to be held in the Mayor's Room at tho Town Hall to-day at 2.30 p.m., to complote arrangements in regard to tho "Victory Shield," which tho ladies'of the Wellington branch propose to proseiit to the boys of the Amokura at tho League's annual meeting and naval demonstration on Monday night. Members will bo supplied with complimentary reserved seat tickets for tho latter. Intending new members aro warmly invited to attend this afternoon, when tho "Victory Shield" will bo on viow. It will bo remembered that, on May 21 : , 1908, Mr. Justico Chapman ordered that the pending action of Hamilton Gilmer and Allen Maguiro (plaintiffs) v. Robert Dwyer (defendant)—a claim for declaration of a partnership in the business of tho Duko of Edinburgh Hotel—should bo tried before a common jury of twelve. On behalf of the plaintiffs, application has now been made that the order in question bo rescinded, upon tho grounds (a) that tho issue involves mixed questions of fact and of law, such as could not bo more conveniently tried by a judge and jury than by a judge, alono; (b) that tho defendant is not entitled by law to have the issuo .tried before a judge and jury of twelvo; and (c) that his Honour exercised his discretion upon an erroneous principle. Tho matter 'will probably bo considered by tho Court of Appeal t-o-day. lii connection with , tho redemption of the " Leader" picturo by ransom, it is understood that objection will be mado by somo City Councillors to the £50 paid for tho recovery of tho painting being mado a charge against tho city. In view of the possibility of that objection being raised, it is more than probablo that tho Mayor and a few of his friends will make up the amount. Tho Mayor states that ho has had several ofFors from disinterested people to subscribe towards tho ransom inonoy if necessary. Tho matter is one for the City Council to deal with. Tho Town' Clerk (Mr. J. R. Palmer) is making inquiries as to whether tho picturo cannot be insured against theft' as well as fire, which opens up tho larger question of tho insurance from fire and theft of tho entiro collection of tho Now Zealand Academy of Fino Arts. l
Oil the application of Mr. M. Chapman, K.C., his Honour tho Chief Justico (Sir Robert Stout) yesterday granted leave to the AVanganui College Board of Trustees to borrow up to £35,000, for the purposo of erecting a new college and developing tho balance of tho estate vested in them. The petition accompanying tho application stated inter alia that "tho property iu quostion comprised 250 acres, and had a frontage of 52 chains to Victoria Avenue, Wanganui, such frontage being at a distance of 33 chains from tho chief Post Offico. Between 1566 and 1882 tlie present college buildings were crected on that portion of the estato nearest to tho centro of tho town, and during tho years ISBS-SG, tho headmaster's resideuce and the collogo cliapcl were built upon tho same part of tho estate. Tho wholo of tho collogo buildings, which wero constructed of wood, had becomo dilapidated and out-of-date. It was now proposed to erect suitablo buildings on a more convenient and less valuable sito in tho interior of the estate, and develop and improvo tho' estato generally. The case of W. Blundell and others, trustees of the Brett Benefit Fund (appellants) v. tho "New Zealand Times" Company, Ltd. (respondents)—which was originally set down for hearing on Saturday last —will bo heard to-day.
Captain Fyler, of H.M.S. Encounter, which arrives to-day from I'icton, has invited tho recently-formed Headmasters' Association to visit his vessel before she leaves again on Saturday week.
