Mr. Levvey appeared on behalf of plaintiff, and Mr. Blair for defendant. : The cases of Hamilton Gilmer and Allan Maguiro (plaintiffs) v. Robert Dwyer and Joseph Dwyer (respondents) were mentioned. These,actions havo boen brought by plaintiffs for declarations'that tliey are partners with tho defendants in connection with the business of the Duke of Edinburgh Hotel, of which Robert Dwyer is tho licensee, and the Royal Hotel, of which Joseph Dwyer is the licensee. Tho defendants deny the existence of any partnership. Tho actions were .set down by the plaintiffs ■. for trial before .'a Judge alone. Sometime ago, however, the defendants'applied for a trial before a jury. The plaintiffs : opposed' tho application, but Mr. Justice Chapman decided ; that the caso should be -tried.before a jury. ' Yesterday a summons by plaintiffs in oach case was heard, in which the plaintiffs asked that the jury should be a special'jury; -instead of a-common one. .His Honour reserved his. decision. Mr. Blair appeared on behalf of the plaintiffs, and Mr. Myers for the defendants.
