Masterton, sued Edward Payne', of Miki-Miki, for £72." Of this sum £56 was for the loss of. seven' cows at £8 per head,' and £16 for depreciation of value of' eight'others. Tho -. plaintiff stated that the defendant had agreed to graze the stock; at Is. per head per week, and,,als6;td.give the animals proper care, and'good feed. The. treatment, or .lack of ' treatment, had ' been such; however; that seven :c'ows bad died, while the remaining eight had fallen in condition seriously. On the other hand, the defendant alleged that tho stock generally was in poor condition when'depastured, and this was tho cause why they were unable to- extricate themselves from a swamp in which several were lost. The Magistrate gave judgment for'the'plaintiff, for £13 10s.; with £6 7s. costs.
