Judgment was; given" bythe Magistrate to-day jn .the case of C..-Sutherland (Bluff) and C. and AV. ■ YounK (Wellington).- .Plaintiff clainied a refund of £39 7s. 4d., tho price of five-thousand cigars, which,' lie alleged,, were dumped "on him by fraud. '-The order for the" cigars-' was said to ' have been taken by Mr.'Montague, traveller for Young's and the cigars •came to hand-during Sutherland's absence- in England, his wife -paying for them. ; On his., return, ..Sutherland' de-' nied. having ordered the-cigars, and ■.•-.in-stituted-proceedings. ' The Magistrate found the facts, ill. Sutherland's favour, but 'did hot imnute fraud to' Montague, believing that thero had-merely ■ been a', mistake. Ho could not, however, give judgment'for plain- \ tiff, as 1500 of • the .-'cigars had been sold for £37 10s., arid plaintiff was very;'little out of pocket with 3500 cigars still on hand. Plaintiff could only rescind now. on' terms disadvantageous to himself.. It . would pay him better ,to keep the cigars, or send them to auction.'
