' ' YN the matter of a proposed Bill or Act in-. litilled an Act to confer certain powers upon - tho Wellington Harbour Board and the Corporation of the Borough of Miramar, and to. enablo the Wellington Harbour Board to acquire certain lands and property, reclaim lands irom. the son, execute works ami borrow monies, and providing for tho payment to the Board ot the valiio of the improvement to adjoining lanc.s arising therefrom. > i ursuant to the Standing Orders of _ the Houso of Representatives relating to Private Bills, tho Wellington Harbour Board gives notice that, either before or within fourteen davs after tho meeting of the General Assembly of Now Zealand, to bo hold next, after tile date •of this notice, a petition will ba presented, through the Honourable the Speaker and Members of Parliament, A3 embers of the House of Representatives, by it praying and applying for leavo to bring in a Private.Bill to bo called "Tho Wellington Harbour Board Reclamation and Empowering Act, 1008." The objccts of the said application and Bill aro as follows:— 1. To enablo the Board to purchase or take compulsorily, under tho provisions of "The Public Works Act, 1905,"..the right, title, and interest of the Wollington Patent Slip Company. Limited, in certain lands, comprised in Certificates of Title, Volume 20, Folio 127, and Voluma 21, Folio 257, and described in the Seventh and Eighth Schedules to tho proposod Bill, and shown as such Schedules on a plan deposited in tho offico of the Marino Department in Wollington, ' and marked M.D. 3157, together with tho buildings, machinery, plant, and assets of tho company, and all rights, privileges, and appurtenances,appertaining thereto, and on such acquisition to enablo tho Patent Slip Company to wind-up under the provisions of Sections 262 to 265, both inclusive, of Tho Companies Act, 1003, and to onable the Board to doviato the existing road through tho said lands. 2. To enable tho Board to purchase or take compulsorily, under the provisions of "The Public Works Act, 1905":— (a.) All thoso three pieces .of land, being parts of Sections A and 7 on the plan of tho Evans Bay District, containing together an area of about 3 roods 30 perches, together with all foreshore rights of accoss, bathing, and all other privileges and powers over so much of tho foreshore at Evans Bay as lies between the eastern and western portions of tho eqid lands; such .pieces of .land are described in the Third Schedule to tho proposed Bill, and shown as such Schedule on the said plan marked M.D. Slli7. Co.) AU that picce of land, being so ronch of Section 2 on tho plan of the Evans Bay District, containing ail area of about 1 rood 14 perches, ;is lies to tho seaward side of tliq Evans Bay Road, and is doscribed in tho Sixth Schedule to tho ' said Bill, and shown as such Schedule on the said plau marked M.D. 0187. 3. To provldo that tho Compensation Court, in determining the amount of compensation to be paid in rcspect of lands compulsorily taken, shall not take into account any incroaso of value arising from tho works of the Board, and also enabling tho Board'to convey Mnd in lisu of paying money awarded for compensation. • 4. To provido that certain lands in Evans Bay, covered by water, shall vest in tho Board, and empowering the Board to reelaipi tho same , and execute works thereon; such lands are doscribed in tho Fifth and Ninth Schedules to tho proposed Bill, and shown as such Schedules on tho said plan marked M.D. 3187. '5. To authorise tho 'Board to construct streets and works ancillary thereto on any land referred to in tho proposed Bill. G. To exoinpt all lands to ba reclaimed under tho authority of tho proposed Bill from payment of rates so long as they remain tho property of tho'Board, and aro not let ot leased. - 7. To onablo tho Board to close certain existing streets in the Borough of Miramar, being tho streets comprised-in tho land described in tho Second Schedule to the proposed Bill, and shown as such Scltedulo on tho said plan marked M.D.. 3187, and to construct in 'lieu thoroof, and in addition thereto, certain other streets on lands, vested, and-to be yosted, in tho Board, and providing that so long as the ,lands described in tho First, ahd tho said 'Second Schedules to the proposed Bill, and shown as such >Schedules on tho said..plan marked M.D. 3187,' shall remain the property ?of the Board, and not bo let or leased, the rates payable by .the: Board shall remain the same as at present. To empower, .the Board and tho 'Corporation of the Borough of Wiiramar to carry out ap Agreement, providing' for tho closing -of streets 011 the land referred to in the First and Second Schedules to tho proposed Bill, and 'shown as such .Schedules on the said; plan marked M.D. 3187, and on* such closure, and on tho Board constructing other streets in lieu thereof, to convey the sanio to tho Board, and empowering the Board to convey portion of the lands described in tho said Schedules to the Miramar • Borough for street purposes, and providing that so long as the Inlids described in the said Schedules Shall Teiilnin' the property of tho Board, and ilot.be let.or leased, the ratc3 payable by the Board shall remain the same as at present. 8. To enable tho Board, for the purpose of rectifying 'boundary lines, stroet levels, and providing access, to purchase of tako in exchange adjoining lands ; or ,soll or give in exchange lands the property of the Board. .9. To vest in the Board ccrtain lands in Evans Bay, bein" laud covered by water, and being the land described in tho Tenth and Eleventh Schedules to the proposed. Bill, and being shown as such Schedules on the said pian marked M.D. 3187. 10. To vest in tho Board tho lands upon which the Boat Sheds at Clyde Quay are constructed, being the lands described in the Twelfth Schedulo to tho proposed Bill, and shown as such Schedule on a plan'deposited in the office of the, .Marino Department in Wellington, and marked M.D. 3188. 11. To enable tho Board to apply to a Court constituted under the proposed Bill and "The Public Works .Act, 19U5," to obtain payment from each and every person having any estate or ihtorcst in land, being a part of tho lands comprised in Sections 2 to S (inolusivd) on the plan of the Evans Bay District, and' Se'ctions 1 to 19 (both inclusive) on the plan Of the Wutts Peniusula District, for the increased value givcii to the Sftld lands through tho works of tho Board. ..... 12. Of tho said plans niarked M.D. 3187 and M.D. 3188, books of reference, and a copy of tho Gazetto Containing tnis advertisement, will be deposited.for public inspection at the offico .of the Commissionoi; of Crown Lands at Wellington, not less than thirty days before tho commOncement of the said Session. At or within ton days after the commencement of the said . Session, a printed copy of the proposed Bill will bo deposited in the office of the Minister of InterinU Affairs.
