DEBTOR ARRIVES IN AUCKLAND. GIVES HIMSELF UP TO POLICE. News was received- in the city yesterday that A. C. Elliott had given himself up to tho polieo at Auckland. Apparently ho had be-en as far as Melbourne, but he returned to Sydney and caught the Moana for Auckland. . The following telegram was received.by Inspector Ellison yesterday"A. C. Elliott, bankrupt, arrived at Auckland from Melbourne via Sydney to-day. Ho camo to the station and surrendered himself. Ho intended going .to Wellington, but had no funds." ... Upon receipt of this message, tho Inspector telegraphed instructions to get Elliott remanded to Wellington on the following charge:— "That on tho 18th of Oct-obor, 1907, at Wellington, having received tho sum of £12 from Henry liobson Wood on-terms requiring him to account for the same to Sir -Kenneth Douglas, he fraudulently omitted to so account for the same, thereby committing theft,"' contrary to Statute, this being an indictablo olfence." This is the only charge at present laid against Elliott, and it was laid by Mr. A. J. Wicks. . Elliott will be formally charged at Auckland 'to-day and remanded to Wellington. .Ho should arrive hero by to-morcow, or 'W cdncsday night's express. Tho Inspector states that on April 30, tho Official Assignee asked him' verbally to try and locate Elliott, as tho Assig'neo did not know where- he was, aiul as it was possible that some charge might be preferred against him as tho outcome of the meeting of May 4, but lie had no grounds for swearing an information pr making a chargo up to then.' Tho Assignee was told, ■ also verbally, o:i May 2, that Elliott had-left for Sydney by tho Maheiio. Inspector Ellison explained that even if EUiott had beon seen on tho wharf leaving for Sydney, tho police could not havo interfered, because, ,at the time, thero was not a single chargo'against him, cr even any suggestion -of one. Neither was thero any statement that he liad committed a criminal offence. Interference by a policeman would havo laid that officer open to a chargo of assault. Tho creditors, ho said, had kicked up a great row and made a lot of snioko to cover their retreat owing to their inaction. No chargo was made until May. 7.
