Mr. P. J. Scantlebury (of Mossrsl Findlay, Dalziell and Co.) appeared in support of the motion. His Honour said that Mr. Pownall seemed to be in some difficulties to get the necessary information. . Ample time 1 had, ho thought been allowed him to do so. However, ho would give him seven clear days further in Trhich to comply with tho order. ' The order made was as follows Leave granted to issue writ; writ to 1 be'in tho office of the' Supromo Court at Wellington until Monday, May 11, before delivery to the-Sheriff; the time for defendant to'be brought before tho Court to be 2 o'clock; on 'Wednesday, May 13; notico to bo issued'forthwith to defendant that theleavo to issue writ has been granted and tho terms thereof. - ... Since the Court proceedings Mr. Pownall has notified Messrs. Findlay, Dalziell and Co. that ho is now prepared to comply with all their requirements in the matter, i. MAGISTRATE'S COURT. (Before- Mr. W. G. Riddell, S.M., on Saturday.)' •• ' Two first offending inebriates were fined 10s., in default forty-eight - hours' imprisonment'. Mary M'Elroy • was sent to prison for twenty-one days with hard labour for using obscene language in Marion Street on Friday night. ■ A sentence of fourteen days' imprisonment was imposed upon David M'Donald for committing an indecent act. ; An elderly man named Thomas De Roane was charged with damaging property, valued at 2s. 6d.; belonging to the Equitable Building Company. He was fined 10s., in default seven days' -. imprisonment, and ordered to pay for the damage done. ; S * A remand was granted in ( a case in which Robert Rollo was charged with the theft of a panama hat, valued at £2 2s;, the property of John 8., Lopdell. Bail, in one surety of £20, was allowed. . A charge of assaulting a Chinaman named Wang Wah was preferroa against James Nelson; alias James Johnston. Evidence was given to the effect that the accused struck and kicked the Chinaman. Nelson was sentenced to one month's imprisonment with hard labour.
