IN thol matter of a proposed Bill or Act intituled an Act to confer certain powers upon the Wellington Harbour Board and Hie Corporation of tho Borough of Miramar, and to •onablo tlio Wellington Harbour Board to acquire certain lands and property, reclaim lands from tho sea, execute works and borrow monies, and providing for tho payment to the Board of the value| of the improvement to adjoining lands arising therefrom. ' - Pursuant to tht Standing of the Houso of Representatives' reletting to Private Bills, the Wellington Harbour Board gives notice thati either before or within fourteen ■days after the meeting of the General Assembly of Now ZeaFand, to bo held next after tho date of this notice,' a petition will be presented, through thelHonourablo the Speaker and Members' of Parliament, Members of the House of Representatives, by it praying aiid applying for leave to bring in a Private Bill to be called ",Tho Wellington Harbour Reclamation and Empowering Act, 1908.' '■ The objects 1 ! of tho said application and Bill aro as follows:— 1. To enable the Board to purchase or talc* compulsorily, hinder the provisions of "The Public Works Act, 1305," the right, title, and interest of the Wellington Patent Slip Company, Limited, 1 in certain lands, comprised in Certificates of Title,' Volume 20, Folio 127, and Volume 21, Folio 287, and described in the Seventh and Eighth Schedules to tho proposed Bill, and shown \is 'such Schedules on a plan deposited in the offico of . tho Marino Department in Wellington, and marked M.D. 3187; together with the buildings, machinery, plant, and assets of the company,' and all rights, privileges, and appurtenances appertaining thereto, and on such acquisition to enable the Patent Slip Company to wind-up under the provisions ; of Sections 262 to 285, both inclusive, of The Companies Act, 1903, and to enable the; Board to doviatetho existing road through the said lands. . ! - . 2. To enable the Board to purchase or take compulsorily, under the' provisions of "The Public Works Act, 1905 ", (a.) All those t three pieces of land, being parts of Sections 5 and 7 on tho plan of the Evans jßay District, containing together an' area of about 3 roods . 30 porches, together with' all foreshore V rights of access, bathing, and all other privileges oiid powers over, so much of the foreshore at Evans Bay as lios between tho eastern and western portions ,' i . of the said'lands; such; pieces of land are described in' the Third Schedule to tho proposed Bill,' and, shown as such Schedule oni the said plan marked'2l.D. 3187. (b.) All that piece of land, being so much of Section 2 on, the plan of the Evans Bay 1 . District, containing an area of about 1 rood 14 perches, as lies to the seaward side of the Evans Bay Road, and is described in tho, Sixth Schedule to. tho said Bill, and'shown as such Schedule on the said jplan marked M.D. 3187.' 3. To provide that the Compensation Court, in determining the amount of compensation to be paid in respect of lands jCompulsorily .taken, shail not take into account any increase of value arising from the works of the Board, and also enabling the Board to convey land in lieu of paying money, awarded for compensation. 4. To provide that certain lands in Evans Bay, covered by water, shall vest in'tho Board, and empowering the Board to reclaim the same and execute works thereon; such lands are described in the Fifth and Ninth Schedules to the proposed Bill, and shown as.such Schedules on the said plan marked M.D. 3187. ' 5. To. authorise tho Board to construct streets and works auxiliary thereto on any land referred to in the. proposed Bill. ' ; , 6. To exempt all'lands to be reclaimed under the authority of the proposed Bill from,payment 1 of rates so'long as they remain the property'of the Board, and are not let or leased. .'. 7. To enable the. Board to close certaiii existing streets in the Borough of Miramar, being tho streets .comprised in the.land described in the Second Schedule , to, the proposed Bill,'and shown. as'such Schedule ony the' said .plan marked M.D. 3187,' and; to construct' in lieu thereof, arid' in addjti'on thereto,' certain pother streets on lands vested,, and;.to'bo vested, in the Board, and providing" that, so long as the lands described in : the and- the said Second Schedules ■ toi. tho ' proposed Bill, and shown, as such Schedules on-the said plan marked M;D. 3187, shall 'remain thoi property ,of th'o-Board, and not'-be let or leased, the rates •payable by the Board''shall'.reraain ,tho same,as at present. - . .To ompov.er the Board and tho Corporation of' the Borough of Miramar to carry out an Agreement,- providing' for '.the'closing-'of streets on the land roferred to.in' the First and Second Schedules to the proposed Bill, and shown as such Schedules on the said-plan marked M.D. 3157, and on such- closure, and on the Board constructing' other streets in lieu .thereof, to convey tho samo to tho Board, and empowering the Board to convey portion' of tho lands described in tho said Schedules to tho .Miramai Borough for street- purposes, and providing that so long as the lands described'in this said .Schedules'shaHremain the property, of the Board, and not be let or leased, tho rates payable bj the Board shall-remain tho suhie as at prosent, 8. To enable! the> Board, for the purpose of rectifying boundary lines, 6treet levels, '■ aud providing access, :to purchase or .tako' in exchange adjoining lands, or sell or give in ex> chango lands the' property of the Board. 9. To vest in the Board certain lands' ir Evans Bay, being land covered, by water, and boing tho land described in the. Tenth ; and Eleventh .Schedules to the proposed Bill, and boing shown as : such Schedules on tho said plan marked M.D. 3187. 10.' To vest in • the Board ' the lands upor which the Boat Sheds at Clyde Quay are constructed, being the' lands described in: fh< ..Twelfth Schedule to the proposed Bill, anc shown as such Schedule-on a plan deposited ir the office of the' Marine Department in . Wellington, and marked 3188. ' 11. v To'eiiablo tho Board to apply to a Courl constituted under tho proposed Bill and "Th< Public- Works: Act, 1905,'' to obtain payment from each and every person having any cstati or intorest in land, being a part of the lands comprised in Sections 2 to 8 (inclusive) on th< plan of tho Evans Bay District, and Seotions ] to. 19 (both inclusive) on the plan of the Watts Peninsula District, for the increased valui given to the said latids through the works-oi tho Board, •'l2.'To enable the Board to borrow ,£1,000,000 wherewith to construct, execute, perform, ant pay for the following works, acts, matters, anc things, or such of.thom as the Board may ii its discretion think fit, with such modificatioi and 'amendment asj' to tho Board may seen meet -.—The purchaso of the undertaking am of all lands authorised to bo acquired unclei this Act, including tho exponses of acquisition tho construction and equipment of patent slips I thoinstallation of workshops, plant,' anc machinery in connection with graving dock: and'slips; tho reclamation of any lands whicl tho Board is or may be authorised to .reclaim including tho purchaso of'all lands necessary in the opinion of tho Board, for such rcclaina tion, -either for spoil purposes'or for purpose; of providing .access to or road frontages foi such reclamations, including the cost of retain iug walls, tho construction of sewers : anc watercourses and of streets; dredging and'thi purchase, hire, and . maintenance of dredginj appliances, and other expenditure coiiuectoc therewith; the construction of quays and quay walls, pitched slopes, and works of a liki nature; the extonsion of existing wharves anc stores, and the construction of now wharves jetties, sheds, offices, and stores, and of cranes and'of other machinery, plant, and appliances other harbour works; the expense's of the flota tion of tho loan or any portion thereof. .
