' The sittings of tho Court of Appeal wero resumed yesterday, when argument in. tlio caso between George Scott, of Christchurch', ! i confectioner (claimant), and-tlio Crown;(respondent). was concluded. Mr. Skerrett, K.C. (with him Sir. T.'.G. Russell, of Christchurch, and Mr. P.'Levi'),' appeared for the claimant, and Mr. G. Harper, of Christchurch (with - him Mr. J. A. Cassidy,. of : Christchurch), for tho King. The' facts, .briefly, were that claimant Was allowed to occupy a display stall and sales stall at the late Now. Zealand . International Exhibition. On December 25, 1907, fch-s: authorities sav/i.fit to exclude Jiim from possession .of the stalls. Claimant thereupon' sued the .Crown for £4500' damages; Tho action • was heard in December last before Mr. Justico Button and a jury, which awarded claimant £500 damages in respect of the alleged wrongful revocation of a license to hold a display stall, and £1000 in respect of the alleged wrongful revocation of a licenso to hold a sales stall. Damages wero awarded on tho assumption that ,tho contract was a valid one, which tho jury found to havo been broken. Argument was now addressed to tlio Court on a number of non-suit points. On behalf of tho Crown it was contended that the contract was made by ..tho Commissioners and not. by tho Crown. If the Crown could ; bo mado responsible for the wrongful act of the Commissioners, then it was not a wrong dono ;in connection with "a public work, and, further, was independent ,of the-contract. . Tho Court reserved its decision.
