John James llyan, -labourer, of Taihape, deposed that lie met Archibald M'Nab and (Sutherland in Wellington about May 21,' 1907. .Witnoss saw M'Nab put his hand in 1 Sutherland's pocket. Tho'party'thel walked down Tory Street, wlioro, they met a man named .Chapman, and they repaired to.the Cricketers' Arras Hotel, after which, with the exception of '''Ginger Tom," tlie.v went to a house in ..Earning Street. - ' While there,, M'Nab gavo Hines and witness £20 each, saying, "This is your wliaclc." Out of the £20., part of which was spent at the second-hand shop, witness received £3 or £4. At the Kilbimio Hotel witness offered a £20 note in payment, for drinks, but as ho could hot get it cashed they proceeded to Newtown, and at a hotel 'Hinos.s' £20 was cashed, , the change, being given mostly in sovereigns.. At "tEo Cambridge Hotel, witness's £20 note was changed, a chei]UO for £15 and the balance .in cash being received from tho licensee. The next day, witness, Hines, Chapman, aiid a man named Keid went again to fclio latter hotel to get tho cheque cashed, but they were unsuccessful, and it was cashed at the Bank of Now Zealand. Witnoss received £-1 out of it. , Witnoss did not see llines for a fortnight or threo weeks afterwards, when the accused'palled at tho Salvation Arniy Home for him. Annie 'M'Donald stated that she was barmaid at the Britannia Fotcl in Mav last, ■and sbo'remembered-a deaf, and durafc man,witli two other men, coming into tho hotol, but she could not say if accuscd was'one' of them.
