CANS , CASE : FOR THE PROSECUTION- FAILS. ~ -Henry Stephen Lake, dairyman, pleaded not gujlty. .to'. a Tcharge,. laid . by. the.Stock Department ,of using /a,,can for distributing milk,/such, can not being, cleaned within four hours .of. using the same. Mr. D. M. Findlay appeared, for the Department, niuV Mr. Clair for, the defence. , Henry Ward; dairy inspector, deposed that he was'at, Mungaroa on March ,3; where ho found h i milk can with two brass labels on. One label 'bore,-the namo "E. Burre'll, Mungaroa," and the other the name "Orsborno and Lake, Wellington." The can was in a very dirty condition,and .had apparently contained milk. It cculd not have,got into such a condition in one day. Ernest E.. Uurroll, farmer, Wallacevilie. stated that lie . used to supply Orsborno. and Lako with milk some .months ago, and was still supplying Lake. .The .can. .in. question belonged .to witness. He had sent, it to Orsborne arid . Lake about four months] ago, and had not seen it since. In cross-exaimn;
■' ' 1 ation, witness stated that: the can' was •' ' - labelled " Mungaroa through mistake j on tho part of tho tinsmith, who placed that label on instoad of Wallaceville. Witness had no idea who had been using the .can in the interval. . - Evidence v.-as also given that : milk cans often . went astray, and were. sometimes used by,-parties other than thAse to. whom they belonged. For. instance, a can labelled'. "Woodville" had been known'to travel'to ' Fc'atherstoii. • ' ' Henry S. Lake stated that he-carried on business under the title, of -Orsborne and:Lnke. Ho had-not received milk -from Mungaroa for six.'years. .Witness'knew the can .in question particularlyi because'it was a' .short-measure ! can, holding' half a- gallon less than it was supposed to hold. He; had not seen! the can for -four or five months,.: and had no idea who had been, using it. At this stage it was intimated' that no further evidence would he called, the i ipartment being satisfied- on: the .-evidence tendered-that defendant :was nit. guilty ■of r the offenco.with which he had bcen-charged.., :The -information ■ was dismissed ..without -costs. , V , . , ■ .
