OPTION OVER A SAWMILL.
Louis: Daroux, photog'raplior, Wellington, sued Alexander Anderson,' of Upper Hutt, fpr £44,- an amount, it was alleged; agreed' to'bo paid by the defendant in consideration: of tho plaintiff foregoing: an- option which ho hold to purchase section 282, Ak'atarawa,' together with a sawmill. The plaintiS alleged that lie wrote a number of letters to. tho de-.' fondant foregoing the option;, and'asking, for payment.-. The:defence.Was that this' option had never been foregone, and could; bo exercised up to the present. His Worship said, tho defendant had,admitted that he had: approached the plaintiff, and'that the amount was discussed' and agreed , oil, but the necessary document was not handed oyer. ■ From his statement, it seemed that defendant was under tho impression that until the document was handed over, tho option still oxisted. Ho did not .seem: to understand :the position. Judgment would be for plaintiff for £44, with costs, £4 2s'. . - Mr. Dix appeared for plaintiff and Mr. Blair for defendant;
