Sitting in Banco yesterday morning Mr. Justice Chapman heard argument relative to 'a''motion for tho dismissal of an interim injunction restraining Mrs. Arini Donnelly ■ and • others from putting stock upon Waimarama land in tho occupation of 'Miss Moinprtzhagen. Mr. 'Morison appeared on behalf of Miss Meinertzhagen, and Messrs. Bell and Skerrett, K.C.'s, for Mrs. Donnelly and others. ./His Honour, after hearing portion of the argument, • said that, as ho had to leave for Gisborno that day, he would bo unablo to dispose/of the matter beforo taking his departure, and, on his suggestion, counsel agreed to have the application heard before Mr. Justice Edwards, who will reach Wellington to-morrow. • INTERIM INJUNCTION GRANTED. ■ Arthur B. Pownall, for whom Mr. Petherick appeared, applied to Mr. Justice Button yesterday morning for an . interim injunction to restrain- John W. Reado from using the word 'f Byko " in connection with his business. Plaintiff, by his statement of claim, set out that ho had been in business in.Wellington as a cycle and wheeled goods dealer since 1895, in which year he coined tho word " Byko," and applied it to his business and business premises. In 1907, the defendant (as ho alleged) wrongfully placed tho same name on his premises! in Manners Street, which, action was calculated to de-ceive,-tho public, and give them to believe that.tho business carried on by tho defendants was the same as that carried on -by plaintiff, and had led to irreparable injury to.plaintiff's business. . His Honour granted an! interim injunction; plaintiff to accept 48 hours', "notice of motion to dissolve tho injunction and to enter into the usual undertaking.
