Sergeant Lyons deposed that on-, tho night of February 8 ho searched defendant's premises under a search warrant and found ono partially -.Hllcd' and recently opened bottlo of beer. , DofeudaiitV wife said tho bottlo in question': had' just j been purchased for private, use. Mr. Wilford • impressed upon tho Court the fact that tho result of the raid was' one half filled bottle of beer.' i ' , Defendant on.oath admitted'that ho gavo Dunn .the beer; on- .both .occasions, but stated that, no payment, was. made for it.' Troublo between two of tbo crew, of the sailing ship Dechmont on January 23 led to Robert Ness, carpenter of the vessel, being charged with assaulting Frederick. Scliliuder, ah A.8,. on tho ship. _ Evideneo was called to prove, that' complainant had words with tho mate on January 2", when defendant' in-! tcrfered 011 behalf of tho mate and inflicted an injury, to complainant's, 1 eye, which had to bo attended to by a' doctor on arrival of the vessel at Wellington. .Complainant' alleged that the assault was quite unprovoked as ho was proceeding about his work, at the direction of tho mate when tho carpenter stepped in. ; Dofendant called evideneo,. to. show that complainant; was of a quarrelsomo disposition and had had'several disputes with tho . mate and members of tho crow during the voyage. " ' ■; His Worship held that the whole matter was perfectly clear, and tho' evideneo was against :'complainant.' It was stated by the police that defendant went "into "Barrett's Hotel on Saturday afternoon,: aiid, on being refused a drink went out into tho street and threw a stono through tho window. °
On tho cbargo of drunkenness defendant was convicted and fined 55., in default 24 hours imprisonment, • and. on " the second charge lio was 'convicted; and fined 40s':'and ordered to pay for tho' broken 'window (£8), laulfc 14 days' imprisonment. \ '
