ARBITRATION COURT.

CLAIM FOR DECLARATION OF . : LIABILITY. Dunedin, February 6; At the Arbitration Court to-day tho caso of M'Niclo v. C. and W. Hayward, being a claim for, declaration of liability, was heard.: Tho claim sot out that tho claimant was employed by respondents as a wood turner; that on August 27,-1907, ho 1 was engaged in cutting at a circular saw; and'that, through slipping on a small'block of wood, tho thumb of his left hand was removed below tho first joint, and that ho was (permanently partially incapacitated. At present ho was receiving £2 9s. Gd. a week from respondents, and sinco the accident lie had recoived from them £8 6s, 2d. Respondents denied that claimant was entitled to a declaration of liability, and stated that sinco October 14 claimant had been employed by them on the sanio class of work as ho was employed in before the accident, . and that ho had been constantly' engaged in such employment at the samo rate of wages as ho earned prior to tho accident. The Court was not satisfied that the work claimant could now do was tho samo In quality and quantity as it was prior to the accident, and decided that claimant was entitled to an order as asked. Costs were al-l-lowed to M'Niclo. - 1
