The whole of the afternoon was spent by Dr.' A: M'Arthur, S.M., in hearing a caso John George Wilson and . Charles Albert Jolly (v. Godfrey Powell, • a claim for the return of £25, deposit paid on the pin-chase of a house. The purchase was to be conir pleted by September 9, but. on (his date the purchasers.srerp, not quite,/ready with their: money, and' on' September, 18 Powell wrote |' cancelling the contract. Defendant claimed that the contract, had' been validly termin-, , ated, . and, that the deposit was therefore properly forfeit. .After hearing argument at length His Worship reserved.,liis decision. It was alleged that .'tho,'macliiiio had been damaged -by a horse belonging. to defendant. ' Plaintiff stated that ho boarded . with defendant at the Zeala'ndia Private Hotel about eight months ago. After plaintiff had been at, the houso some months, he purchased a bicyclo •which, he alleged, defendant told him could be kept in a certain shed 'in the yard. 1 He. kept the machine in tlie shed, but a week or two later defendant put a pony into the shed, the'result being that the pony kicked the bicycle, and made a wreck-of it. -Plaintiff- claimed for the value of the machine.Defendant urged that plaintiff had not been granted permission to put.' the bicycle in this particular shed, another shed being set' aside specially for bicycles owned by boarders.- Evidence .was/called to show that bicycles were kept in the shed indicated by defendant, nnd that it was well-known in the -house that the pony' was kept in the shed where plaintiff kept his bicycle. His Worship entered judgment for defendant, with costs £2 ]p5. Mr. Blair appeared'for plaintiff, and Mr. Herdman for defendant.

' • SALE OF A TYPEWRITER, Judgment was given in the case Searle Joy 'and Company, trading as The New Zealand Typewriting: and Supplies Company v. Norman L. Gurr, a claim for £11 13s. Bd., balance due on the sale of a typewriter. Tho case was adjourned at the original hearing' to allow expert evidence to be called by defendant, but His Worship, on looking through the evidence, decidcd that there was no need to call' tho 'expert ovidence. The. Court held that on the evidence and correspondence it was perfectly clear that plaintiffs were entitled to judgment,. Judgment would be for plaintiffs for the amount claimed, and costs £3 9s. Mr. Von Haast appeared for plaintiffs, and Mr. P. Jackson for defendant. '
