On January 2 prosecutor gave him a severe beating. On the following day witness and prosecutor again fought. Is cither Was'sober. He (accused) knocked prosecutor down three times. ,As prosecutor would not get up afeain ho went away. His' Worship held thai the evidence was against accused. Falls on tho hard ground might hav^'been responsible for somo of tho injuries. Accused might have had some provocation, but, in the opinion of the Court, not sufficient to warrant hira in committing such an aggravated assault. He (His Worship) woukT-lake into consideration the fact that,accused Bad been in gaol eighteen day 3 awaiting trial. Accused would be sentenced to ono month's imprisonment, with hard labour; > : ■
